El Equipo Latinoamericano de Justicia y Género (ELA), Women Enabled International (WEI), el Circulo Emancipador de Mujeres y Niñas con Discapacidad de Chile (CIMUNIDIS), Círculo de Mujeres con Discapacidad (CIMUDIS), y la Red por los Derechos de las Personas con Discapacidad (REDI) presentan un informe amicus curiae sobre el caso Beatriz vs. El Salvador ante la Corte Interamericana de Derechos Humanos. El informe destaca que los Estados tienen la obligación de garantizar el derecho de las mujeres y otras personas con capacidad de gestar con y sin discapacidad a acceder a servicios de aborto legal, seguro y de calidad, en particular cuando el embarazo representa un riesgo para su vida y su salud, tal como ocurría en el caso de Beatriz.

En el informe se destaca que:

● Las mujeres y otras personas con capacidad de gestar con y sin discapacidad tienen derecho a acceder a servicios de aborto legal, seguro y de calidad, en particular cuando el embarazo representa un riesgo para su vida y su salud.

● El caso de Beatriz pone en evidencia que el Estado salvadoreño inclumple su obligación de adoptar las medidas que resulten adecuadas para garantizar el acceso a servicios de aborto legales, seguros y de calidad de las mujeres y otras personas con capacidad de gestar con y sin discapacidad a la luz de normativas del sistema interamericano de derechos humanos y de tratados de derechos humanos de la Organización de Naciones Unidas;

● La penalización absoluta del aborto -como la existente en El Salvador- lesiona el derecho de las mujeres y otras personas con capacidad de gestar con y sin discapacidad, y constituye una forma de violencia de género. En algunas circunstancias también puede puede constituir tortura o trato cruel, inhumano o degradante;

● Los Estados, incluido El Salvador, deben tomar medidas efectivas para eliminar el estigma y la discriminación contra las personas con discapacidad sin afectar los derechos humanos fundamentales de las mujeres y otras personas con capacidad de gestar y, en particular, sin obstaculizar su acceso a servicios de aborto legales, seguros y de calidad.

The briefs highlights that:

● Women and other persons with and without disabilities have the right to access legal, safe and quality abortion services, particularly when pregnancy poses a risk to their life and health.

● Beatriz’s case shows that the Salvadoran State is failing in its obligation to take the appropriate measures to guarantee access to legal, safe and quality abortion services for women and other persons with and without disabilities in the light of the regulations of the inter-American human rights system and human rights treaties of the United Nations;

● The absolute criminalization of abortion – such as that existing in El Salvador – harms the right of women and other persons with the capacity to become pregnant with and without disabilities, and constitutes a form of gender-based violence. In some circumstances it may also constitute torture or cruel, inhuman or degrading treatment;

● States, including El Salvador, should take effective measures to eliminate stigma and discrimination against persons with disabilities without affecting the fundamental human rights of women and other persons with the capacity to become pregnant and, in particular, without impeding their access to legal, safe and quality abortion services.
