Fact Sheet: Sexual and Reproductive Health and Rights of Women and Girls with Disabilities

Women and girls with disabilities account for almost one-fifth of the world’s population of women, and they are just as likely to be sexually active as their peers without disabilities 2 despite inaccurate stereotypical views to the contrary. Accordingly, they have the same sexual and reproductive health (SRH) needs as women and girls without disabilities. Due to multiple and intersecting forms of discrimination on the basis of gender and disability, however, women and girls with disabilities face unique and pervasive barriers to full realization of their sexual and reproductive health and rights (SRHR).

Las mujeres y niñas con discapacidad representan casi una quinta parte de la población mundial de mujeres1, y tienen las mismas probabilidades de ser sexualmente activas que sus pares sin discapacidad2 a pesar de los puntos de vista estereotipados inexactos que sostienen lo contrario. WEI Fact Sheet: The Right of Women and Girls with Disabilities to be Free from Gender-Based Violence

Women and girls with disabilities, who make up almost one-fifth of the world’s population of women, are at least two to three times more likely than women without disabilities to experience gender-based violence in various spheres.  They are also likely to experience abuse over a longer period of time, resulting in more severe injuries. Women with disabilities experience both the same forms of gender-based violence, as well as unique forms as a result of their disability; they also experience distinct barriers to escaping such violence and seeking justice. However, existing laws, policies, and programs on gender-based violence seldom address the specific concerns of women and girls with disabilities, and it is difficult to find accurate and comprehensive data disaggregated by both gender and disability.

Las mujeres y niñas con discapacidad son casi un quinto de la población mundial de mujeres y son al menos de dos a tres veces más proclives a experimentar violencia de género en varias esferas en relación con las mujeres sin discapacidad. También es más probable que experimenten abuso durante un periodo de tiempo más largo, lo cual resulta en daños más severos. WEI Fact Sheet: The Right to Education for Women and Girls with Disabilities

Despite having the same rights to education as their male counterparts and non-disabled peers, girls with disabilities are the most excluded group of children from all educational settings from primary school to higher education settings due to multiple and intersecting forms of discrimination on the basis of both their gender and their disability. However, existing laws, policies, and programs do not adequately address the various educational barriers faced by women and girls with disabilities.

Fact Sheet: Access to Justice for Women and Girls with Disabilities

Women and girls with disabilities, who make up almost one-fifth of the world’s population of women, face significant barriers to accessing justice, due to discrimination on the basis of both gender and disability, accessibility barriers to the justice system, and lack of reasonable accommodations throughout judicial proceedings. Compared to both men with disabilities and women without disabilities, women with disabilities are disproportionately excluded from legal protection and are more likely to have their credibility questioned, owing to harmful gender and disability stereotypes. Women with disabilities also encounter barriers to attaining positions as lawyers, judges, and other officials in the justice system, and may be excluded from serving on juries. Such barriers not only limit the ability of women with disabilities to use the justice system, but also limit their ability to contribute to the administration of justice to society as a whole.

Access to justice is interdependent with a number of fundamental rights. Effective access to justice is essential for challenging human rights violations, such as discrimination in employment or deprivation of parental rights. Lack of access to justice can reinforce vulnerability to rights violations, particularly where perpetrators may feel emboldened when they know the justice system is unlikely to respond to complaints by women with disabilities. Access to justice also depends on the fulfillment of other rights—realization of the right to accessibility, for instance, will often determine whether women with disabilities have effective access to the justice system.

WEI Fact Sheet: Legal Capacity of Women and Girls with Disabilities

Discriminatory laws frequently deny women with disabilities their right to legal capacity under substituted decision-making regimes, such as guardianship, conservatorship, and health laws that permit forced treatment. The denial of legal capacity gives rise to numerous other violations of fundamental rights, including the rights to marry and found a family; make autonomous and voluntary decisions about sexual and reproductive health; give or withhold consent to intimate relationships; and seek accountability for various forms of abuse through the justice system.

Fact Sheet: Rights of Women and Girls with Disabilities in Conflict and Humanitarian Emergencies

Women, girls, and gender non-conforming people with disabilities are disproportionally impacted by conflict and humanitarian emergencies due to multiple and intersecting forms of discrimination that heighten their exclusion and risks. Women with disabilities, particularly those with intellectual and psychosocial disabilities, are particularly vulnerable to sexual and gender-based violence before, during, and after conflict and in humanitarian situations. Women with disabilities also encounter heightened barriers to programs and services in emergency settings, as well as barriers to sexual and reproductive health services. Despite the distinct challenges facing women with disabilities—and thus the important perspective they can bring to addressing these challenges—women with disabilities are routinely excluded from both peace building processes and recovery following natural disasters. Failure to engage women with disabilities in these efforts perpetuates exclusion, discrimination, and violations of their human rights.
